For the February edition of the Assagenti Newsletter, Dr. Giacomo Desirello Poggi analyzes the main provisions of Law No. 9 of 26 January 2026 (“Provisions on the safety of underwater activities”): from the analysis of the entities responsible for the direction and coordination of policies related to the underwater domain (Art. 3), to the establishment of the Agency for the Safety of Underwater Activities (“ASAS”) and its functions (Arts. 4-12), up to the regulations concerning the safety of underwater technical operators (“OTS”) and hyperbaric technicians (“TI”).
In particular, new professional qualifications are introduced, along with a new regulatory framework governing the register of underwater and hyperbaric operators and the requirements for registration (Arts. 19-21).
Finally, noteworthy is Art. 22, which regulates the practice of the profession based on qualifications obtained abroad: professionals in the sector who are citizens of the European Union, a State belonging to the European Economic Area, or Switzerland, if qualified to carry out the relevant professions under the laws of one of those States, will have the right to practice their profession in Italy, both on a temporary and occasional basis and on a permanent basis.
